These Terms govern your use of the Gheorghe-Marius Muscalu website and the purchase of Primiva from Gheorghe-Marius Muscalu ("we", "us"), Rue des Tigres 5, 4030 Liège, Belgium, Sole trader (individual).
1. Acceptable Use
You may use this website for lawful purposes only. You must not use the site to transmit harmful, fraudulent or unlawful content, attempt to gain unauthorised access to our systems, or interfere with the site's operation.
2. Order and Sale Process
Orders are placed by submitting your name and phone number via the order form. Submitting the form does not constitute a binding contract. A binding agreement is formed only when an operator calls to confirm your order and you accept. We reserve the right to decline any order at our discretion. Prices are stated in New Zealand Dollars (NZD) and include applicable GST. The price for Primiva is NZD $69.99 per pack of 90 capsules (promotional price; full price $139.99). Payment is made in cash or by bank card to the courier upon delivery - no online prepayment is required. You may cancel your order at no cost at any time before dispatch by informing the operator during the confirmation call or by contacting us.
3. Limitation of Liability and Supplement Disclaimer
Primiva is a food supplement, not a medicine. Nothing on this website constitutes medical advice. We are not liable for any loss or damage arising from reliance on information on this site. Our total liability to you in connection with any order shall not exceed the price paid for that order. Nothing in these Terms limits liability for death or personal injury caused by our negligence or for fraud.
4. Intellectual Property
All content on this website - including text, images, logos and layout - is the property of Gheorghe-Marius Muscalu or its licensors and is protected by copyright. You may not reproduce or redistribute any content without prior written permission.
5. Returns and Right of Withdrawal
You have the right to return an unopened pack within 14 calendar days of receipt for a full refund, consistent with the Consumer Guarantees Act 1993 (NZ) and consumer protection principles. Full details are in our Return Policy.
6. Dispute Resolution
We aim to resolve any complaints informally. Please contact us in the first instance at [email protected]. If we cannot resolve a dispute, it may be referred to the Disputes Tribunal of New Zealand.
7. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes shall be subject to the exclusive jurisdiction of the New Zealand courts.
